As a built environment Consultant you provide ‘supervision’ services to your clients in terms of your professional services mandate contract. In this regard you are appointed to fulfil a role such as an Agent, Principal Agent, Engineer, or Project Manager.Supervisor in a FIDIC NEC JBCC or GCC or another proprietary contract between your Client and a Contractor. In addition the terms of the standard templates are often amended or supplemented altering the interpretation and compliance obligations, and therefore the professional liability risks, of Consultants

Arcadis reports that poor contract administration and the Parties either not understanding or complying with their contractual obligations are the main causes of disputes, cost overruns and delays.

We are able to assist you to mitigate these risks including by -
  • Creating a ‘conformed’ version of the construction contract that integrates some or all of the contract components into the contract general conditions giving you greater visibility for consultants compliance obligations in risk and opportunities assessment,
  • Providing a risk report detailing ambiguities, conflicts and specific risk issues that impact your professional liabilities and on the administration of your contractual relationships,
  • Providing training, coaching, and mentoring on the contracts from the consultants perspective in which contractual provisions are deconstructed and legal liabilities are identified,
  • Advising on the supervisions liabilities of consultants under the common law and the contracts,
  • Providing a hot desk to answer your questions as and when they occur.
